Este artículo critica la constitucionalización de los derechos de la naturaleza como una construcción del discurso que refleja la colonización jurídica. Los derechos de la naturaleza reflejan una dicotomía cuya genealogía es la división entre naturaleza y cultura. Se propone un cambio de enfoque que consiste en diluir esta dicotomía, dando paso a la inclusión de los terceros provenientes del mundo indígena kichwa Saraguro y amazónico.

Este trabajo intenta dar contenido a los derechos de la naturaleza desde los pensamientos filosóficos de los pueblos indígenas, así como desde la interacción o encuentro entre diversas formas de conocimiento; en especial el de la Amazonía y el kichwa; pretendiendo construir otro saber-poder con el que se propone una crítica al dominante. Para ello el trabajo se estructura en tres partes: crítica, reconstrucción y aplicabilidad. La crítica consiste en un diagnóstico teórico desde la aproximación al fundamento filosófico dicotómico que (...) separa el ser humano de la naturaleza cosificándola evidenciando como esta dicotomía atraviesa los estudios disciplinares y transdisciplinares sobre sus derechos. La reconstrucción se elaborará desde la meta-física dusseliana y, finalmente, se intentará demostrar las implicaciones de la aplicación fáctica de esta propuesta, relacionada con: aprender, aprehender y desaprender a través de una perspectiva transdisciplinar y analéctica capaz de abarcar personas, plantas, animales, agua, piedras, etc. como un todo en armonía. El presente trabajo realiza una breve exposición de las estructuras de relación recíprocas del pueblo kichwa Saraguro en el actuar colectivo de la mukuna; dentro del mismo se devela la ética económica del cuidado de la vida que subyace a tal matriz, así como las normas que rigen su manifestación y desarrollo. Defiende la comunidad como campo de expresión de ciertas individualidades no individuales, de reafirmación comunitaria, de lucha y relación económico que destruye la acumulación del capital.

Este trabajo presenta una propuesta biologizada del arte y la Filosofía Indígena desde el pueblo kichwa Saraguro, con el fin de discutir especialmente los fundamentos de los derechos de la naturaleza. Aunque, hay que resaltar que, el sitio de enunciación no es estrictamente el lugar descrito; porque la matriz de discusión es el Sumak Kawsay que involucra a Latinoamérica en general. La metodología que se usa es la transdisciplinar. El orden de desarrollo está enmarcado en una primera parte que desarrolla (...) a modo teórico la presencia del arte y la estética en el mundo indígena. Luego, se presenta un breve análisis de campo, específicamente una discusión con el artista kichwa Saraguro Luis Antonio Lozano. Se concluye que existe un contenido religioso, espiritual o Trascendental en el arte y la estética kichwa Saraguro, que puede aportar para el desarrollo del fundamento filosófico de los derechos de la naturaleza y el Sumak Kawsay. Este trabajo critica la categoría blanquitud, en la corriente iniciada por Bolívar Echeverría. El método que se utiliza es el transdisciplinario, como pretensión de disolución de las parcelas de conocimiento. Se toma tres campos filosóficos: la Teología de la liberación; la Filosofía de la liberación y la Filosofía indígena. En el análisis lingüístico se utiliza como herramienta, la poesía y novela de Rosario Castellanos, Elena Poniatowska, Gioconda Belli y Ernesto Cardenal. El lugar de enunciación es el pueblo kichwa Saraguro. Se (...) postula que el Sumak Kawsay es un más allá de los derechos de la naturaleza; como uno de los antónimos de la blanquitud. Empero, la blanquitud no es solamente el color del capitalismo; es decir, si las personas son las que construyen las instituciones, entonces, son estos sujetos quienes cargan con lo blanco. La blanquitud es también un fenotipo del racismo: complejo de superioridad e inferioridad. Racismo que se traduce en posesión o acaparamiento económico, académico, político, etc. La reversión filosófica o descolonización de lo blanco se postula desde una educación sin dominación, a través de la concreción, cuidado y reproducción de la vida Sumak Kawsay. Este estudio propone algunas bases para investigar el pluralismo jurídico, la interculturalidad, los derechos de la naturaleza y el sumak kawsay. Es un discurso contextual con base real y proyección mundial desde los contextos indígenas. Su lugar de partida es el pueblo kichwa Saraguro, de la provincia de Loja, Ecuador. Su teoría permite hacer comparaciones con estudios etnológicos, antropológicos y sociológicos de la Amazonía, los pueblos kichwa de la Sierra y las reflexiones indigenistas. El método es interdisciplinar, antidisciplinar o transdisciplinar. (...) Aborda especialmente la construcción colonial del sujeto indígena y hace una reconstrucción histórica para mostrar lo negativo y lo positivo de esta. The favorable reception that was received for the book Per salvare la democrazia in Italia (Rubbettino, 2019) did not prevent some demanding readers from raising objections to some passages included in part five of the book, containing proposals to improve the functioning of our democratic system. It was therefore decided to take advantage of the period of forced domicile imposed by the pandemic to write this new book, whose primary objective is to clarify the passages in question while explaining the (...) proposed innovative solutions in a simpler manner, starting with the description of his own career path and ending with a suggestion for changing the way of doing politics in Italy. Team semantics is a highly general framework for logics which describe dependencies and independencies among variables. Typically, the dependencies considered in this context are properties of sets of configurations or data records. We show how team semantics can be further generalized to support languages for the discussion of interventionist counterfactuals and causal dependencies, such as those that arise in manipulationist theories of causation. We show that the “causal teams” we introduce in the present paper can be used for modelling some (...) classical counterfactual scenarios which are not captured by the usual causal models. We then analyse the basic properties of our counterfactual languages and discuss extensively the differences with respect to the Lewisian tradition. (shrink)

A dichotomy result of Sevenster (2014) [29] completely classified the quantifier prefixes of regular Independence-Friendly (IF) logic according to the patterns of quantifier dependence they contain. On one hand, prefixes that contain “Henkin” or “signalling” patterns were shown to characterize fragments of IF logic that capture NP-complete problems; all the remaining prefixes were shown instead to be essentially first-order. In the present paper we develop the machinery which is needed in order to extend the results of Sevenster to non-prenex, regular (...) IF sentences. This involves shifting attention from quantifier prefixes to a (rather general) class of syntactical tree prefixes. We partially classify the fragments of regular IF logic that are thus determined by syntactical trees; in particular, a) we identify four classes of tree prefixes that are neither signaling nor Henkin, and yet express NP-complete problems and other second-order concepts; and b) we give more general criteria for checking the first-orderness of an IF sentence. We analyze the causal-observational languages that were introduced in Barbero and Sandu (2018), which allow discussing interventionist counterfactuals and functional dependencies in a unified framework. In particular, we systematically investigate the expressive power of these languages in causal team semantics, and we provide complete natural deduction calculi for each language. Furthermore, we introduce a generalized semantics which allows representing uncertainty about the causal laws, and we analyze the expressive power and proof theory of the causal-observational languages over this enriched semantics.

One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives. We analyze the expressive resources of \ logic that do not stem from Henkin quantification. When one restricts attention to regular \ sentences, this amounts to the study of the fragment of \ logic which is individuated by the game-theoretical property of action recall. We prove that the fragment of prenex AR sentences can express all existential second-order properties. We then show that the same can be achieved in the non-prenex fragment of AR, by using “signalling by disjunction” instead of (...) Henkin or signalling patterns. We also study irregular IF logic and analyze its correspondence to regular IF logic. By using new methods, we prove that the game-theoretical property of knowledge memory is a first-order syntactical constraint also for irregular sentences, and we identify another new first-order fragment. Finally we discover that irregular prefixes behave quite differently in finite and infinite models. In particular, we show that, over infinite structures, every irregular prefix is equivalent to a regular one; and we present an irregular prefix which is second order on finite models but collapses to a first-order prefix on infinite models. We analyze the behaviour of declarations of independence between existential quantifiers in quantifier prefixes of Independence-Friendly (IF) sentences; we give a syntactical criterion to decide whether a sentence beginning with such prefix exists, such that its truth values may be affected by removal of the declaration of independence. We extend the result also to equilibrium semantics values for undetermined IF sentences.

A uniform carbon tax with equal per capita dividends is usually advocated as a cost-effective way of reducing greenhouse gas (GHG) emissions without increasing, and in many cases even reducing, economic inequality, in particular because of the positive balance between the carbon taxes paid by the worse off and the carbon dividends they receive back. In this article, I argue that a uniform carbon tax reform is unjust regardless of how the revenue is used, because it does not discourage the (...) rich from indulging in wasteful emissions. This is at odds with a normative account of the distribution of the GHG budget that I define as emissions limitarianism, which is a climate derivative of economic limitarianism. Emissions limitarianism holds that, under low GHG budget conditions, emissions permits should not be used to achieve functionings that over-consume the GHG budget without producing significant welfare gains relative to the achievement of alternative functionings. Accordingly, I argue that a uniform carbon tax should be complemented by a limitarian carbon tax, which restricts the capabilities of the rich to achieve wasteful emission-generating functionings. The article adopts a methodological multi-level perspective on capabilities as a measure of welfare, distinguishing between basic, secondary and tertiary capabilities. (shrink)

In this article I argue that the non-reciprocity problem does not apply to intergenerational justice. Future generations impact, here and now, on the well-being of people now living. I firstly illustrate the economic-synchronic model of direct intergenerational reciprocity (DIR): future generations allow people now living to maintain the economic system future-oriented and capital-preserving. The rational choice for people now living is to guarantee transgenerational sufficiency to future generations. I then analyse the axiological-synchronic model of DIR: future generations give meaning and (...) value to many of the activities that people now living carry out, and this is a compelling reason for the latter to worry about the former. I argue that only the economic-synchronic model of DIR can consistently explain why we need future generations. I conclude by discussing the limits of indirect intergenerational reciprocity. We challenge the classic experience/expression dichotomous account of emotions, according to which experiencing and expressing an emotion are two independent processes. By endorsing Dewey's and Mead's accounts of emotions, and capitalizing upon recent empirical findings, we propose that expression is part of the emotional experience. This proposal partly challenges the purely constructivist approach endorsed by the authors of the target article.

In a paper that recently appeared in this journal, we proposed a model that aims at providing a comprehensive account of our ability to intelligently use tools, bridging sensorimotor and reasoning-based explanations of this ability. Central to our model is the notion of generalized motor programs for tool use, which we defined as a synthesis between classic motor programs, as described in the scientific literature, and Peircean habits. In his commentary, Osiurak proposes a critique of the notion of generalized motor (...) program, and suggests that the limitations of our model can be solved by integrating it with the view that motor programs are generated by a previous mechanical reasoning, independent from sensorimotor knowledge. Here we reply that while on the one hand our reference to Peircean habits gets over the temptation to consider motor programs as fixed internal entities, it also rejects the view, endorsed by Osiurak, that intelligent practice is a mixture of antecedent abstract reasoning and subsequent motor execution. We analyse the two definitions of generalized quantifiers for logics of dependence and independence that have been proposed by F. Engström, comparing them with a more general, higher order definition of team quantifier. We show that Engström’s definitions can be identified, by means of appropriate lifts, with special classes of team quantifiers. We point out that the new team quantifiers express a quantitative and a qualitative component, while Engström’s quantifiers only range over the latter. We further argue that Engström’s definitions (...) are just embeddings of the first-order generalized quantifiers into team semantics, and fail to capture an adequate notion of team-theoretical generalized quantifier, save for the special cases in which the quantifiers are applied to flat formulas. We also raise several doubts concerning the meaningfulness of the monotone/nonmonotone distinction in this context. In the appendix we develop some proof theory for Engström’s quantifiers. (shrink)

O objetivo deste artigo é a análise das críticas de Hannah Arendt à concepção dos direitos humanos, introduzida pelo pensamento dos filósofos contratualistas e efetivada, politicamente, pelas revoluções americanas e francesas no final do século XVIII. Contudo, este objetivo não seria plenamente alcançado sem a avaliação da proposta de Arendt para a superação de suas próprias críticas: a reconstrução dos direitos humanos através do reconhecimento que cada indivíduo tem direito a ter direitos, independente das fronteiras do Estado-nação. Arendt vai buscar (...) na moral universalista e cosmopolita kantiana o conceito de humanidade e dá a ele as dimensões ontológicas e políticas necessárias para se construir um espaço público internacional, onde o direito a ter direito seja decorrente do mero pertencimento à humanidade, não se dissolvendo nos limites de cada Estado-nação. The purpose of this article is the analysis of the criticisms of Hannah Arendt's conception of human rights, introduced by the thought of the contractual philosophers and made effective, politically, by American and French revolutions in the late eighteenth century. However, this aim would not be fully achieved without the review of Arendt's proposal to overcome her own criticisms: the reconstruction of human rights by recognizing that every individual has the right to have rights, regardless of borders of the Nation-State. Arendt tries to discover in the universal and cosmopolitan moral of Kant the concept of humanity and gives him the ontological and political dimensions needed to build an international public space where the right to have rights is due to the mere belonging to the humanity, not dissolving itself in the limits of each Nation-State. In the literature on logics of imperfect information it is often stated, incorrectly, that the Game-Theoretical Semantics of Independence-Friendly quantifiers captures the idea that the players of semantical games are forced to make some moves without knowledge of the moves of other players. We survey here the alternative semantics for IF logic that have been suggested in order to enforce this “epistemic reading” of sentences. We introduce some new proposals, and a more general logical language which distinguishes between “independence from (...) actions” and “independence from strategies”. New semantics for IF logic can be obtained by choosing embeddings of the set of IF sentences into this larger language. We compare all the semantics proposed and their purported game-theoretical justifications, and disprove a few claims that have been made in the literature. (shrink)

In this article I analyse those that I consider the most powerful counterarguments that have been advanced against the non-identity objection to the idea of intergenerational harm, according to which an action cannot cause harm to a given agent if her biological identity does actually depend—in a partial but still determinant way—on the performance of this action. In doing this, I firstly go through the deontological criticisms to the person-affecting view of harm, before moving on to sufficientarian and communitarian accounts (...) of intergenerational harm. My argument is that neither of these theories manage to defuse the non-identity objection. Yet, I conclude by observing that a possible way out of the non-identity paradox might consist in developing an ethical account of intergenerational negative justice that focuses on the functional value of the natural and social structures in which humans develop their lives, rather than on their instrumental or intrinsic value. Given current data, only a few binary Boolean operators are expressed in lexically simple fashion in the world's languages: and, or, nor. These do not occur in every combination, for example, nor is not observed by itself. To explain these cross‐linguistic patterns, we propose an encoding of Boolean operators as update procedures to accept or reject information in a context. We define a measure of conceptual simplicity for such updates, on which attested operators are conceptually simpler than the remaining Booleans. (...) Moreover, we show that language evolution selects for the attested lexical inventories by minimizing the complexity of using a lexical inventory compositionally to convey precise information. Questo contributo considera e analizza specifici elementi pagani celtici nella Navigatio sancti Brendani, soprattutto attraverso la comparazione con il genere epico tradizionale degli immrama e delle echtrai. Il proposito è quello di dimostrare la continuità di alcuni tradizionali concetti religiosi irlandesi sull’escatologia e la visione dell’aldilà in questi testi, particolarmente nell’ambito delle funzioni religiose espresse nelle figure di Brendano, di Barinto e degli dèi irlandesi del mare Manannán e Mongán. Attraverso le osservazioni svolte, si può stabilire che questa continuità funzionale (...) non è basata su un passivo lavoro di ricezione, ma è generata da un autentico sforzo di comprensione degli elementi cruciali che hanno determinato l’originalità e la sostanza della struttura escatologica della Navigatio. It is common in contemporary sport to liken the notion of the team to that of the family. That is, the family is used to evoke team life. Portraying the team as a family usually implies a positive evaluation. Despite its prevalence, the team as a family equation has not been analyzed in the sport philosophy literature. Thus, the purpose of this article is twofold. First, it explores whether the team is to be equated with the family. To discuss the (...) nature of the family and the team, I draw together the work of several sport philosophers with that of Laura Wildemann Kane. Second, and considering what characterizes the team, this article investigates whether teammates have special responsibilities to one another by virtue of their relationship and the value attached to it. I propose that the team as a family equation does not align with the constitution of these two social groups and that teammates have special responsibilities to one another, but such responsibilities are different from those observed in the family. Despite society’s increasing sensitivity toward green production, companies often struggle to find effective communication strategies that induce consumers to buy green products or engage in other environmentally friendly behaviors. To add clarity to this situation, we investigated the effectiveness of negative versus positive message framing in promoting green products, whereby companies highlight the detrimental versus beneficial environmental consequences of choosing less versus more green options, respectively. Across four experiments, we show that negatively framed messages are more effective than positively framed (...) ones in prompting consumers to engage in pro-environmental behaviors. More importantly, we find that anticipated shame is the emotion responsible for this effect. Furthermore, both environmental concern and the type of product promoted serve as moderators; thus, the mediating role of anticipated shame is attenuated when environmental concern is low and the product is a luxury one. Finally, we discuss the theoretical and managerial implications of our work, along with its limitations and some directions for future research. (shrink)

In this article, I query whether participation in the labour market can hinder neo-republican freedom as non-domination. I briefly present the view of Philip Pettit on the topic, based on the distinction between offering a reward and threatening a punishment. I compare it to the analysis of labour republicans, recently reconstructed by Alex Gourevitch, according to whom, the exclusion of a group of individuals from the control of productive assets represents a form of structural domination. Then, I explain why I (...) take a position that is different from both. I hold that capitalist structural domination leads only to exploitation, not interpersonal domination. In doing this, I consider two objections that might be raised against my argument. The first one is based on incomplete contracts and on a possible ideal benchmark for job offers. The second one challenges the supposed arbitrariness of unequal property relations within the capitalist social system. (shrink)

Natural languages exhibit manysemantic universals, that is, properties of meaning shared across all languages. In this paper, we develop an explanation of one very prominent semantic universal, the monotonicity universal. While the existing work has shown that quantifiers satisfying the monotonicity universal are easier to learn, we provide a more complete explanation by considering the emergence of quantifiers from the perspective of cultural evolution. In particular, we show that quantifiers satisfy the monotonicity universal evolve reliably in an iterated learning paradigm (...) with neural networks as agents. (shrink)
